The platform provider is SOFTWARE MESAS.REST SpA, Chilean Tax ID 78.505.188-2. By creating an account, purchasing a plan or using the service, you represent that you have authority to accept these terms.
1. Service and scope
mesas.rest is a technology platform for restaurant operations. Depending on the plan and configuration, its features may include POS, tables, orders, kitchen display, inventory, reservations, QR menus, delivery, integrated payments, CRM, reports and workforce management.
Third-party features, integrations and payment services may be subject to availability, technical requirements and the separate terms of their providers.
2. Accounts, users and security
The restaurant must provide accurate information and keep it current. It is responsible for protecting credentials, assigning roles and permissions correctly, removing access when appropriate and supervising its users. Any unauthorized access must be reported promptly to soporte@mesas.rest.
Each user must use an individual account. Credentials may not be shared in a way that prevents an action from being attributed to the person who performed it.
3. Plans, trials and payment
Pricing, duration, taxes, limits and included features are those disclosed when the plan is purchased. A free trial may have limited features or duration. Automatic renewal applies only when it has been disclosed and accepted.
Charges are non-refundable after a paid period begins unless required by law, the accepted offer or a service failure attributable to mesas.rest.
4. Acceptable use
The platform may be used only for lawful activities related to restaurant operations. Users may not bypass security controls, access another restaurant's information, introduce malicious code, conduct unauthorized testing, impersonate another person, resell the service without written authorization or infringe third-party rights.
5. Information and personal data
The restaurant is responsible for the legality, quality and relevance of the data it enters and for providing notices to staff and guests when required. mesas.rest processes the information necessary to provide the service. The restaurant must export any information it needs before permanently closing its account, within the period communicated to it.
6. QR menu, reservations and delivery
The restaurant is the seller and remains responsible to its guests for products, prices, availability, ingredients, allergens, preparation, receipts, delivery times, cancellations and refunds. mesas.rest provides the technology and does not sell the restaurant's products unless expressly stated otherwise.
7. Integrated payments
When a payment processor is enabled, authorization and settlement depend on that provider. mesas.rest does not guarantee transaction approval and does not store complete card credentials. Chargebacks, refunds and reconciliation are also governed by the processor's terms and applicable law.
8. Availability, support and technical changes
We work to provide a stable and secure service, but maintenance, connectivity failures and events outside our reasonable control may occur. We will provide reasonable notice of material scheduled interruptions when practical. Features may be changed to improve security, compatibility or legal compliance.
9. Intellectual property
The platform, software, design, documentation, trademarks and proprietary content belong to SOFTWARE MESAS.REST SpA or its licensors. A subscription grants only a limited, revocable, non-exclusive and non-transferable right to use the service during the plan term. The restaurant retains ownership of its brand, menu, images and data.
10. Suspension and termination
Access may be suspended for non-payment, security risk, unlawful use, harm to others or material breach. When reasonably possible, the reason will be communicated and an opportunity to cure will be provided. Termination does not eliminate accrued payment obligations or terms that are intended to survive.
11. Responsibility
Each party is responsible for its own actions and obligations. To the maximum extent allowed by law, mesas.rest is not responsible for restaurant business decisions, products sold, errors in entered data, third-party services or indirect loss caused by events outside its reasonable control. Nothing in these terms limits rights or liability that cannot lawfully be waived.
12. Changes, governing law and contact
Material changes will be communicated through a reasonable channel. These terms are governed by the laws of the Republic of Chile, without limiting any mandatory consumer rights that apply in the user's jurisdiction.
